1. Acceptance of Terms
By creating an account on AskFitness ("the Platform"), you ("Subscriber" or "Gym Owner") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. AskFitness is operated by AskFitness Technologies Private Limited ("Company", "we", "us").
2. Description of Service
AskFitness provides a cloud-based gym and sports-academy management platform including member management, scheduling, billing, CRM, analytics, and AI-powered coaching tools. The Platform is provided on a subscription basis (SaaS). All features are subject to the plan you subscribe to.
3. Account Registration
You must provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@askfitness.in of any unauthorised access.
4. Subscription and Billing
Subscriptions are billed in advance on a monthly or annual basis. All prices are in Indian Rupees (INR) and exclusive of applicable taxes (GST 18%). Payments are processed via Razorpay. We reserve the right to change pricing with 30 days' notice. Refunds are not provided for partial billing periods except where required by applicable law.
5. Free Trial
New accounts receive a 14-day free trial. No credit card is required for the trial. At the end of the trial, the account will be suspended until a paid plan is selected. Trial accounts are limited to one per business entity.
6. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws
- Upload or transmit any content that is defamatory, obscene, or fraudulent
- Attempt to reverse-engineer, decompile, or disassemble the Platform
- Share your account credentials with unauthorised persons
- Use the Platform to send unsolicited communications (spam)
- Interfere with or disrupt the integrity or performance of the Platform
7. Data and Privacy
You retain ownership of all member data you input into the Platform. By using the Platform, you grant us a limited licence to process this data solely to provide the services described herein. We process personal data in accordance with our Privacy Policy and applicable data protection laws including the Digital Personal Data Protection Act 2023 (India).
8. Intellectual Property
The Platform, including its design, software, trademarks, and content, is owned by AskFitness Technologies Private Limited and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Platform without our prior written consent.
9. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.
10. Termination
You may cancel your subscription at any time from the Settings page. We may suspend or terminate your account for breach of these Terms. On termination, your data will be retained for 30 days and then permanently deleted, unless a longer retention period is required by law.
11. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
